Terms of Service & EULA

Terms of Service & EULA

Effective: September 14, 2026 · Version 2026-09-14 · NAV STAR SOFTWARE STUDIOS INC.

1. Summary

Eligibility depends on your country: you must be at least 13 in the United States and Australia, 14 in Canada, and 18 in India. Optional digital purchases, if enabled, are processed by Apple and remain subject to Apple’s policies and all mandatory consumer rights. Public player communication is unavailable unless the required safety controls are enabled. These Terms supplement Apple’s Standard Licensed Application End User License Agreement and do not remove rights that cannot lawfully be excluded.

2. Agreement, operator, and Apple terms

Ascend: Rise to Power is operated by NAV STAR SOFTWARE STUDIOS INC., a British Columbia, Canada corporation, which offers the game under the Ascend Game brand (“Nav Star,” “we,” “us,” or “our”). These Terms are an agreement between you and NAV STAR SOFTWARE STUDIOS INC. The current release is offered for iPhone through Apple’s App Store in Canada, the United States, Australia, and India only.

Apple’s Standard Licensed Application End User License Agreement and mandatory App Store terms control if they conflict with these supplemental Terms. Apple is not responsible for the game’s maintenance or support except as Apple’s terms require and may be a third-party beneficiary where its terms provide. Android availability has not been announced; Android-specific terms would apply only if Android distribution is later announced.

You agree separately to these Terms and acknowledge that you have read the Privacy Policy. We will provide reasonable advance notice of material changes. Where renewed agreement is required, the game will present the updated Terms and obtain affirmative acceptance before continued account use. Changes do not retroactively reduce accrued consumer rights.

3. Eligibility and permitted use

You must meet the minimum age for your country of residence: 13 in the United States and Australia, 14 in Canada, and 18 in India. Users below the applicable threshold may not use the game. If you are below the age of majority but meet the applicable minimum age, you must have parent or guardian permission where required. We do not ask for a full birth date.

Nav Star grants you a personal, revocable, non-exclusive, non-transferable licence to use the game for non-commercial entertainment on Apple-branded products you own or control, subject to Apple’s usage rules. You must not reverse engineer, exploit, resell, disrupt, automate, or use the game unlawfully.

4. Accounts, recovery, and deletion

The game may provide guest access tied to a pseudonymous identifier. Account recovery is free. “Recover an account with prior purchases” means recovery of an eligible account and restoration of eligible Apple purchases are different processes. Apple may restore eligible non-consumable purchases; consumable purchases are not restorable through Apple. Deliberate account deletion permanently ends access and must not silently reactivate a deleted identity.

You can initiate deletion in Settings or contact privacy@ascendrisetopower.com. Access is revoked immediately after a confirmed deletion request. We remove active profile and gameplay information promptly and generally within 30 days. Backups expire through their normal protected rotation within the period stated in the Privacy Policy. We may retain restricted purchase, refund, fraud, security, legal-compliance, consent, and request records when reasonably required by law or to establish, exercise, or defend legal claims. Retained records are not used to restore deleted gameplay. Deletion does not automatically create a refund; mandatory refund and consumer rights remain unaffected.

5. Community Rules, user content, and safety

Display names are user-generated content. Do not submit personal information, impersonation, infringement, hate, threats, harassment, sexual exploitation, profanity, illegal content, or deceptive material. Do not use the game to threaten self-harm or harm to others. In an immediate danger or emergency, contact local emergency services or current official crisis resources; Nav Star is not a health or emergency service.

We may filter, investigate, rename, restrict, remove, suspend, or ban content or access using a proportionate process. Automated moderation may use Replit’s Gemini AI Integration for narrow contextual classification of deterministic ambiguous chat content; deterministic rules remain authoritative. The system fails closed when the provider or response is unavailable or uncertain, and automated moderation may create false positives or false negatives. We do not promise perfect accuracy. Where reasonably possible, we provide a reason, notice, and an appeal route. We may act immediately for serious security, fraud, abuse, or safety threats. Report safety, child-safety, moderation, or imminent-threat concerns to safety@ascendrisetopower.com. Use support@ascendrisetopower.com for ordinary player support and appeals. These Community Rules apply to public names and any future user-content features.

Alliance chat may be enabled only while automated moderation, reporting, blocking, enforcement, retention, and fail-closed controls are available. Messages that cannot be classified safely are not published. Moderator staffing is not a launch prerequisite. Optional owner/admin review tools and player appeals remain available.

You grant Nav Star a limited licence to host, reproduce, display, filter, moderate, and transmit your User Content only as reasonably necessary to operate, secure, improve, and enforce the game. The licence ends after deletion except for content already lawfully shared, moderation evidence, legal holds, and records required to be retained. We do not use player content in advertising without separate permission.

6. Virtual items, purchases, and Battle Passes

Gems and other virtual items are licensed digital game content. They have no cash value, are not property or legal tender, cannot be cashed out or redeemed, are non-transferable outside authorised game mechanics, cannot be used for wagering, and cannot be exchanged for money or monetary prizes. The game does not offer deposits, stakes, cash prizes, paid random rewards, or transferable monetary value.

Purchases are unavailable unless and until they are enabled in the game. When enabled, purchases are processed by Apple and are subject to Apple’s applicable terms and refund processes. Except where a refund, replacement, or other remedy is required by law or available under Apple’s policies, purchases are non-refundable. Nothing in these Terms limits mandatory consumer rights.

A Battle Pass, if offered, is a one-time, non-renewing seasonal purchase unless Apple expressly presents it as a subscription. Before purchase, the game will disclose the price, season start and end dates, included benefits, whether unused tiers expire, and whether anything carries forward. We will give reasonable notice where practicable before changing purchased content, fulfil purchased entitlements, and provide refunds, replacements, credits, or other remedies where required by law or Apple policy.

7. Availability, suspension, and intellectual property

We may maintain, change, suspend, or discontinue features for security, legal, technical, or product reasons. We may restrict accounts for material rule violations, fraud, abuse, or legal requirements. Where reasonably possible, we will provide notice and reasons and offer an appeal through support@ascendrisetopower.com. No action forfeits legally protected rights or mandatory remedies.

The game and its fictional and procedurally generated content, code, artwork, marks, and systems are owned by NAV STAR SOFTWARE STUDIOS INC. or its licensors. Third-party materials remain subject to their applicable licences. Do not copy or use them except as this licence or applicable law permits.

8. Fictional and procedurally generated content

Ascend is fictional entertainment, not medical, legal, financial, educational, or professional advice. Some game content may be procedurally generated. Gameplay systems may adjust challenges or content based on game state, but they do not secretly change paid-product prices and do not use sensitive information, age, or protected traits to personalize prices or purchase pressure.

9. Warranties, liability, and indemnity

To the maximum extent permitted by applicable law, the game is provided “as is” and “as available.” Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory warranty, right, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the maximum extent permitted by applicable law and subject to those mandatory rights, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. Any lawful monetary limit does not apply to fraud, wilful misconduct, gross negligence, personal injury where applicable, or other liability that cannot legally be limited or excluded. You will indemnify Nav Star only for losses reasonably caused by your unlawful conduct, wilful misconduct, or infringement of a third party’s rights.

10. Regional rights, governing law, and contact

United States: this is a general-audience 13+ service, not directed to children under 13. State consumer rights apply where applicable.

Canada and Québec: mandatory federal and provincial consumer protections and language rights remain available. French-language Terms, Privacy Policy, deletion information, and material purchase disclosures are available for Québec users.

Australia: services come with guarantees that cannot be excluded under the Australian Consumer Law. You may have rights to repair, replacement, refund, compensation, or other remedies.

India: access is limited to people 18 or older. Applicable consumer, grievance, and regulator rights remain available.

These Terms are governed by the laws of British Columbia and the applicable laws of Canada, without depriving you of mandatory rights under the laws of your place of residence. Subject to those mandatory rights, the courts of British Columbia have non-exclusive jurisdiction. Nothing prevents either party from using an applicable small-claims process, regulator, consumer-protection body, or another remedy that cannot lawfully be excluded. Contact legal@ascendrisetopower.com or support@ascendrisetopower.com. We generally respond to verified privacy and legal requests within 30 calendar days, or sooner when applicable law requires.
